Description:

Justice Denied: The Role of Forensic Science in the Miscarriage of Justice tells the story of some of the so-called experts who have paraded themselves through the courts, and gives an account of the terrible miscarriages of justice that have often resulted. Unfortunately, we are not unique in South Africa. The maladies chronicled occur throughout the world, across legal systems. Never has there been a greater need to examine what the state offers as forensic evidence, and never has there been a greater need for scepticism and vigilance. The necessity for watchfulness in the world of prosecutions and forensic science is amply demonstrated by the headline in the Cape Times of 28 March 2014: 'Man freed after 45 years on death row'. Nowhere is the ultra-reliance on the extraction of confessions more starkly illustrated as a faulty method for solving cases than in this matter. Mr Iwao Hakamada spent forty-five years on death row. Only because of the extreme inefficiency of the Japanese justice system was he not executed. His conviction followed what was, it seems, the faulty extraction of a confession from him using methods that we now know are highly likely to produce false confessions. The ability of modern forensic technology to exonerate him must stand as one of the more significant milestones in the onward march of forensic science.
